Terms & Conditions of Participation
THUNDERBALL! Indoor Qualification Program
1. You acknowledge and agree that you have obtained and reviewed the following “Official Event Rules” regarding the “THUNDERBALL! Qualifying Program (the “Event”) to be held on Full Swing Simulators worldwide in conjunction with Viking Management I (the “Company”).
Said “Official Event Rules” are incorporated herein in full by this reference, and you agree that you understand them and agree to be bound by them by participating in any qualifying process for the Event using any Full Swing Golf, Inc. golf simulator.
2. Participation in the Event and all qualifying processes through the use of any Full Swing Golf, Inc. golf simulator is expressly conditioned on your acceptance of and agreement to these Terms and Conditions of Participation. By participating in the qualifying processes described below you acknowledge receipt of and the adequacy of all consideration provided by Full Swing Golf, Inc. in exchange for your agreement to be bound by these Terms and Conditions of Participation.
3. Agreement to these Terms and Conditions of Participation is an irrevocable condition of participation.
4. You understand that the qualifying process for the Event, as such process will occur at this location, is as follows:
a. You may purchase trials online at www.thunderball.net whereby you obtain trial ‘codes’ that once input on the participating Full Swing simulator touch screen enables you to hit eight (8) shots, the longest of which will be viewable online via the live ‘leaderboard’ for the THUNDERBALL! program
b. You may purchase as many trials as you desire
c. Each shot is ranked by venue, country & nation and viewable on the online leaderboard (http://thunderball.net/indoor-qualifying-results/)
d. The top 50 on the overall leaderboard will gain entry to the THUNDERBALL! main event held August 18-21 at Bears Best Golf Club in Las Vegas, NV. Additional entries may be invited at the discretion of the Company
e. All eligible main event finalists must purchase in full the following inbound travel package on or before July 1st, 2010 in order to participate in the main event:
4 Nights hotel stay at South Point Hotel & Casino – Host hotel of THUNDERBALL!
2 Tickets for THUNDERBALL! Main Event
1 ‘All Access’ players badge for entire tournament weekend
2 Rounds of golf at Bear’s Best Golf Club – 1 during THUNDERBALL! weekend and 1 ‘anytime’ voucher
1 THUNDERBALL! Welcome gift package
1 Booklet of value added coupons for host hotel amenities
1 Unlimited driving range use throughout weekend
1 DVD copy of TV Show
1 ‘Vegas Nightlife’ concierge service
Package Price: $795.oo
5. You acknowledge and agree that Full Swing Golf, Inc. shall have no liability for any technical issues or difficulties of any and every kind and description adversely impacting the registration, calculation, or transmission of any shot, including but expressly not limited to the following: any failure to register any golf shot made by you; any computer or tracking errors; any Internet transmission errors; any environmental condition; or any simulator calibration differences, variances, miscalculation, or error. Nor shall Full Swing Golf, Inc. have any liability for any negligence or error by the owner/operator of the golf simulator in operating same, or recording or transmitting any data to Full Swing Golf, Inc.
6. You acknowledge and agree that all trial codes must be entered by you at the golf simulator precisely as provided to you. Any incorrect entry will invalidate any golf shots made under the incorrect entry. You acknowledge and agree that Full Swing Golf, Inc. shall have no liability for any erroneous entry of any ticket number, and/or any consequences resulting therefrom.
7. You agree to hold Full Swing Golf, Inc. and its officers, directors, employees, agents, successors, and assigns harmless from and against–and hereby waive any right to pursue–any claims of any nature arising in connection with Full Swing Golf, Inc.’s use of your name or likeness in any manner in its sole and absolute discretion.
8. You agree that all results as determined by the location at which you choose to participate are final and may not be appealed.
9. All participants must be at least 18 years of age unless otherwise stated or posted.
10. Neither Full Swing Golf, Inc. nor its officers, directors, employees, agents, successors, or assigns shall be liable for any warranty, costs, damage, injury, or any other claim or claims incurred as a result of any participation in the Event or any qualifying process thereof. You understand and acknowledge that golf can be a hazardous sport and activity, and substantial risks of physical injury are inherent in it. You assume all such risk, and any and all risk of using any Full Swing Golf, Inc. golf simulator.
11. If the Event is cancelled for any reason, Full Swing Golf, Inc. nor the participating Qualifying Site shall bear any responsibility to the participant to compensate them with either cash or prizes.
12. This qualifying process is null and void in any jurisdiction where prohibited by law.
13. Full Swing Golf, Inc. reserves the right in its sole and absolute discretion to terminate any and all qualifying at any location without prior notice.
14. Full Swing Golf, Inc. and the Company reserves the right in its sole and absolute discretion to alter any rules of qualifying at any time.
15. A valid form of identification is required for participation in the main event and you agree to pay all applicable income taxes from any cash prizes earned through the program.
16. Employees of Full Swing Golf, Inc., and its affiliates, parent companies and subsidiary companies, if any, and their immediate families (parents and children) are not eligible to participate in the Event or any qualifying therefor through the use of any Full Swing Golf, Inc. golf simulators.
